Terms and Conditions
Use of Facility: I agree upon booking or entering the Hoop City Facility, I will adhere to the rules and guidelines in place. I recognize that failure to do so may result in removal, or suspension from the venue. Actions resulting in removal from the premises will include; vandalism, inappropriate language, misuse of equipment, physical violence, or intimidating mistreatment of staff, disturbing the peace or abuse of other members or customers of any form.
Privacy
Hoop City collects and records personal information.
Hoop City acknowledges that every individual’s privacy is very important and that they have a right to control their information. Hoop City also recognises and accepts the legislative requirements to manage the privacy of personal information.
Hoop City is committed to providing protection for personal information and giving an individual the choice as to who can access their information and how the information is used. Therefore, in the absence of explicit consent to act otherwise, the following policy will govern how Hoop City will manage an individual’s personal information and safeguard their privacy.
Personal information is ‘information or an opinion about an identified individual, or an individual who is reasonably identifiable.
Where the personal information is no longer required for the purpose, it was collected Hoop City will take all reasonable steps to securely destroy or permanently remove the information from all our systems.
Hoop City ‘s Website
Does not collect personal information other than information provided voluntarily by the individual.
Collection of Records
Hoop City records personal information because:
• An individual provides it to us because we need it to provide a service that has been requested by the individual or through a third party.
• An Individual has provided it to us as part of improving our services.
• The individual works for us.
• In some circumstances we may be provided with personal information from third parties.
Disclosure of Personal Information
Hoop City may disclose your personal information to third parties as part of providing the individual with a service or where required or permitted by law. Otherwise, we will seek the individual’s consent before disclosure.
Security of Personal Information
Hoop City will take all reasonable steps to ensure personal information is stored in a manner that reasonably protects it from misuse, loss or unauthorised access, modification or disclosure. In the event of a personal information security breach immediate steps will be taken.
Payment/s
I acknowledge that all online payments, direct debits, and credit card transactions will be made via the EzyPay platform. I agree to the EzyPay terms and conditions and acknowledge that the transaction fees are set by EzyPay.
I accept that failure to make a payment or failure to have sufficient funds available at the time of the transactions that I may be liable for additional fees and charges at the full discretion of EzyPay and/or Hoop City.
Memberships
Sign Up
I agree that upon purchasing a membership I am abiding by the Hoop City terms and conditions, and agree to make all necessary payments as required. All Junior Memberships must be purchased by a parent or guardian. Cancellations: I agree to provide a minimum one month notice on the cancellation of any membership with a minimum term commitment. I agree that 30% of the monies remaining under the agreed minimum term commitment will not be refundable. The non-refundable monies cover administration and business costs incurred.
Session Bookings
Bookings
I accept that Session Bookings cannot be made further than two weeks in advance. I understand that all bookings should be made via the Hoop City Hapana platform from either the Hoop City app or website.
Cancellation / Rescheduling Policy:
I agree to provide a minimum of 24-hours’ notice for any cancellation to a booking, and a failure to do so, will mean the loss of monies and/or credits (no refunds will be provided). Cancellations that are communicated more than 24 hours before the commencement of the booking can reschedule without ramifications.
- If a session is missed due to illness, a valid medical certificate must be provided in order to receive a credit for the missed session.
- Participants are permitted to miss one (1) session per term due to changing or unforeseen circumstances and will receive a credit for that session.
- This is the only non-medical credit allowed per term.
- If Hoop City cancels a session due to venue availability or circumstances outside of our control, a credit will be issued for the affected session.
- All credits must be used within the same term and will expire at the end of that term if unused.
- No-shows without prior notice or without a medical certificate will not be entitled to a refund or credit replacement.
- Additional missed sessions beyond the allowances above will not be eligible for a refund or credit.
Gym
Strong Room
I understand that anyone under the age of 16 years is NOT allowed to enter the gym (strong room) without Supervision from Hoop City employee or contractor.
Children Under 12
Athletes 12 years of age or under will require an adult (parent, guardian or designated adult over 18 years) to sign in and out of the facility
Transfers
I accept that I cannot transfer any funds, credits or bookings to any other individual, including family and friends, and that if found to so do, may lead to loss of membership, removal from venue or suspension from venue, at the discretion of Hoop City.
Induction
I agree to undertake an onsite induction with Hoop City employee or contractor to ensure and understand the safe and appropriate use of all equipment and technology including induction of the gym (strong room).
General
I agree that Hoop City may, in our absolute discretion, change these terms and conditions from time to time without notice to you, and acknowledge that if any part of any of these terms and conditions is void, then the part that is void may be severed. I understand that any dispute arising out of these Terms and Conditions are governed by the laws of Victoria, Australia.
